These Terms of Service ("Terms") constitute a legally binding agreement between Aformix ("Company," "we," "us," or "our") and you ("Client," "user," or "your"), governing your access to and use of our services, including but not limited to web development, UI/UX design, full-stack development, and digital solutions. By accessing, browsing, or using any Aformix service, website, or product, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease access to our services. These Terms apply to all individuals, businesses, and organizations engaging with Aformix. Additional terms may apply to specific services or projects, and in the event of conflict, project-specific terms shall take precedence.
Aformix provides comprehensive web development, design, and digital solutions as detailed above. The specific scope of services will be outlined in individual project agreements or statements of work.

Professional interface and user experience design including prototyping and user research.
End-to-end development using MongoDB, Express, React, and Node.js technologies.
Ongoing maintenance, bug fixes, updates, and technical support for deployed solutions.
Support with hosting setup, deployment, and infrastructure optimization.
Complete branding strategies and digital transformation solutions for businesses.
Provide truthful, accurate, and complete information during project consultation and throughout engagement.
Provide constructive feedback and approvals within agreed timeframes to maintain project momentum.
Use our services only for lawful purposes and in compliance with all applicable laws and regulations.
Maintain confidentiality of login credentials and notify us immediately of any unauthorized access.
Respect third-party intellectual property rights and obtain necessary licenses for content provided.
Ensure all content and projects comply with local, state, and international laws.
Payment Terms and Conditions: • Project Pricing: All pricing is as quoted in the project proposal or statement of work and is non-binding until formal acceptance. • Payment Schedule: Projects typically require a 50% upfront deposit to initiate work. The remaining balance is due upon project completion or as outlined in the project agreement. • Accepted Payment Methods: We accept bank transfers, credit/debit cards, digital payment platforms, and other methods as agreed upon. • Refund Policy: Deposits are non-refundable after project initiation. Partial refunds may be issued for incomplete services due to mutual termination. Completed work is non-refundable. • Late Payment Consequences: Projects may be paused if payment is not received within 7 days of the invoice date. Additional late fees of 1.5% per month may apply. Repeated late payments may result in service termination. • Subscription Services: If applicable, subscription renewals occur automatically on the date specified. Cancellation must be requested in writing before renewal. • Currency and Taxes: All fees are displayed in USD. Additional taxes or fees may apply based on location and applicable regulations. • Price Changes: We reserve the right to modify service pricing with 30 days' notice to existing clients.
Project Delivery Guidelines: • Estimated Timelines: Project timelines provided are estimates and may vary based on project complexity, client feedback, and scope changes. • Revision Rounds: Standard project packages include a specified number of revision rounds. Additional revisions may incur extra fees. • Client Responsibility: Delays in providing content, feedback, or approvals may extend project timelines proportionally. • Delayed Requirements: Missing requirements, unclear specifications, or delayed feedback from your end may postpone delivery dates. • Deployment Limitations: While we assist with deployment, third-party hosting providers' terms and limitations apply. We are not responsible for uptime or provider-related issues. • Acceptance Criteria: Projects are considered complete upon client approval. Once approved and final payment received, clients assume responsibility for maintenance. • Communication: We will maintain regular communication through agreed channels (email, project management tools, meetings).
Intellectual Property Ownership: • Client-Provided Assets: You retain full ownership of content, data, images, text, and other materials you provide to Aformix. • Aformix Intellectual Property: All design concepts, code frameworks, methodologies, and proprietary tools created by Aformix remain our exclusive property unless explicitly licensed. • Work Product Ownership: Upon receipt of full payment, clients receive rights to custom code and design created specifically for their project. This excludes reusable templates, components, and frameworks. • Portfolio Rights: Unless otherwise agreed, Aformix reserves the right to showcase your project in our portfolio, case studies, and marketing materials (with client name anonymized if requested). • Third-Party Licenses: Any third-party libraries, frameworks, or tools integrated into your project are governed by their respective licenses. Aformix is not responsible for license compliance. • Restrictions: Without explicit written permission, clients may not resell, redistribute, or license our work to third parties or claim it as their own creation. • Derivative Works: Any modifications to our provided code or designs remain subject to original licensing terms.
Use of our services for any illegal, fraudulent, or unethical purposes.
Attempting to breach, hack, or introduce malicious code into our systems or client applications.
Uploading or using copyrighted content without proper licensing or permissions.
Using services to deceive, defraud, or harm others through misrepresentation.
Attempting to access systems, accounts, or data without authorization.
Using services to harass, threaten, bully, or abuse individuals or groups.
Limitation of Liability: • Service Interruptions: Aformix is not liable for temporary service interruptions, downtime, or data loss not caused by our negligence. • Third-Party Services: We are not responsible for failures or issues with third-party services, hosting providers, or payment gateways. • Force Majeure: Aformix is not responsible for delays or failures caused by circumstances beyond reasonable control (natural disasters, wars, pandemics, etc.). • Indirect Damages: To the maximum extent permitted by law, Aformix shall not be liable for indirect, incidental, consequential, special, or punitive damages. • Liability Cap: Our total liability for any claim shall not exceed the total amount paid by you for services in the past 12 months. • No Warranty: Services are provided "as is" without warranties of merchantability, fitness for particular purpose, or non-infringement. • Data Loss: While we implement security measures, clients are responsible for maintaining data backups. We are not liable for data loss from any cause.
Aformix may terminate services if you breach these Terms and fail to remedy within 15 days of written notice.
Services will be suspended and may be terminated if payments are not received within 30 days of due date.
Immediate termination if services are used for illegal, fraudulent, or harmful purposes.
Termination for harassment, spam, hacking attempts, or other abusive behavior.
Clients may terminate ongoing projects with 30 days' notice, though deposits are non-refundable.
Services naturally terminate upon successful project completion and client acceptance.
Third-Party Services: Our solutions may integrate with third-party services and platforms including: • Hosting Providers (Vercel, AWS, DigitalOcean, Netlify) • Payment Gateways (Stripe, PayPal, Square) • APIs (Google, Meta, OpenAI, various data providers) • Analytics Services (Google Analytics, Mixpanel) • Cloud Platforms (Firebase, MongoDB Atlas) • Email Services (SendGrid, Mailgun) • CDNs and Content Delivery Networks These third-party services are governed by their own terms and privacy policies. Aformix is not responsible for their availability, functionality, or compliance. You must review and accept their terms independently. We are not liable for any issues, data breaches, or service failures from third parties.
